Data Protection at the TU Braunschweig

as the data protection officer of the TU Braunschweig I am at the disposal for every collaborator and student in case of questions to data protection. I assist the university administration in the implementation of data protection and advise in every fundamental question with reference to saving and processing of personal data. I support you for example at the compliance with and assurance of data protection at your working place, or personal problems/ conflicts with data protection.

In consultation I gladly present the mainly issues and principles of data protection to you and your collaborators, or other interested groups at your or my place of work (Campus Nord, Bienroder Weg 80, room 017b). If you wish so I will tread your request, notification or complaint privately.

Mainly basis of my job is in special the “General Data Protection Regulation (GDPR, https://eur-lex.europa.eu/legal-content/en/TXT/?qid=1462345886854&uri=OJ:JOL_2016_119_R_0001)”, which is effective since 25th May 2019 and the data protection act of Lower Saxony (NDSG, also effective since 25th May 2019, www.lfd.niedersachsen.de), which can be found at NI-VORIS.
In addition there are some more regulations that apply for processing personal data at the TU Braunschweig:
The information service regulation (effective since 15.07.2000),
the regulation for IT safety of the TU Braunschweig (effective since 12.06.2012),
the usage regulation for information technology of the TU Braunschweig (effective since 08.07.2003),
the regulation for processing personal data (effective since 12.06.2012),
and other field specific regulations. However, to a large part this regulations must be adjusted to the GDPR and the new NDSG.

The GDPR, which must be applied over the national law, contains several regulation requirements and “opening clauses”, which should allow the EU member states to interpret certain points of the GDPR, in accordance to requirements on national or federal state level. In Germany the resulting law on national level is the "Gesetz zur Anpassung des Datenschutzrechts an die Verordnung (EU) 2016/679 und zur Umsetzung der Richtlinie (EU) 2016/680 (Datenschutz-Anpassungs- und -Umsetzungsgesetz EU – DSAnpUG-EU)", which was passed by the Bundestag and Bundesrat at May 2017. On german federal state level the primary choice of law in lower saxony is the new NDSG, which is supplementary to the GDPR. If there are data protection aspects in the GDPR that are not specifically regulated by law, or data protection regulations of the GDPR and the NDSG contradict each other, the GDPR must be applied over the NDSG. Under certain circumstances (participation at economic competition and processing of personal data) also the according regulations of the new “German data protection act” (BDSG) must be applied as part of the DSAnpUG-EU.

Because of the new salutary regulations, there are a lot of – partly significant - innovations for the TU Braunschweig, the collaborators and the data protection officer. More information is prepared at “EU-Datenschutz-Grundverordnung”.

If you think that a processing of personal data is violating the GDPR or other data protection regulations, you have the lawful right (Art. 77 EUDSGVO) to officially complain at a supervisory authority (for example at the data protection officer of lower saxony (LfD)). The supervisory authority will inform the complainant about the outcome of the complaint, including the possibility of an effective judicial remedy (art. 78 GDPR).

Suggestions for supportive measures for Data protection at TU Braunschweig at a whole or in specific cases are always welcomed.
